CITY OF CONVERSE           X

 

A RESOLUTION CALLING FOR AN ELECTION ON THE UNIFORM ELECTION DATE IN MAY 2007 AND PLACING ON THE BALLOT THE PROPOSITION: SHALL SECTION 5.01b and 5.01c OF THE CITY CHARTER BE AMENDED.

 

WHEREAS, Section 5.01b and 5.01c of the City of Converse Home Rule Charter is dated and requires clarification and consideration of additional staffing; and,

 

WHEREAS, the Charter Review Commission recommends amendment of Section 5.01b and 5.01c; and,

 

WHEREAS, a City wide election is required to amend the City Charter to clarify this issue;

 

NOW, THEREFORE, BE IT RESOLVED by the Charter Review Commission of the City of Converse that an election be conducted on the uniform election date in May 2007 on the proposition:

 

Shall Section 5.01b and 5.01c of the city charter which reads as follows:

 

Section 5.01 City Manager.

 

b.   Acting Manager. By letter filed with the City Secretary, the manager shall designate, subject to approval of Council, a qualified city administrative officer to exercise the powers and perform the duties of manager during his temporary absence or disability. During such absence or disability, the council may revoke such designation at any time and appoint another officer of the city to serve until the manager shall return or his disability shall cease.

 

c.   Powers and Duties of City Manager. The city manager shall be the Chief administrative officer of the city. He shall be responsible to the council for the administration of all city affairs placed in his charge by or under this Charter. He shall have the following powers and duties.

 

(1)   He shall appoint and, when he deems it necessary for the good of the city, suspend or remove all city employees and appointive administrative officers provided for by or under this Charter, except as otherwise provided by law, this Charter, or personnel rules adopted pursuant to this Charter. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency.

 

(2)   He shall direct and supervise the administration of all departments, officers, and agencies of the city, except as otherwise provided by this Charter or by law.

 

(3)   He shall attend all council meetings and shall have the right to take part in discussion but may not vote.

 

(4)   He shall see that all laws, provisions of this Charter and acts of the council, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed.

 

(5)   He shall prepare and submit the annual budget and capital program to the council.

 

(6)   He shall ensure that the city master plan is maintained and all changes approved by the city council.

 

(7)   He shall submit to the council and make available to the public a complete report on the finances and administrative activities of the city as of the end of each fiscal year.

 

(8)   He shall make such other reports as the council may require concerning the operations of the city departments, offices and agencies subject to his direction and supervision.

 

(9)   He shall keep the council fully advised as to the financial condition and future needs of the city and make such recommendations to the council concerning the affairs of the city as he deems desirable.

 

(10)           He shall perform such other duties as are specified in this Charter or may be required by the council.

 

(11)           He shall keep a written inventory of all real property and all permanent equipment belonging to the city, said inventory to be subject to annual audit. A system shall be established to control the use and replacement of expendable items.

 

 

Be changed to read:

c.       Assistant City Manager.  The Assistant City Manager shall be appointed by the City Manager to assist the City Manager in fulfilling the above listed responsibilities.  The Assistant City Manager shall act as City Manager during the disability or absence of the City Manager.  The Assistant City Manager while acting as City Manager shall have the rights, authority, and duties conferred to the City Manager by this Charter and other City Council approved delegations.  The City Manager may by letter, filed with the City Secretary, designate a qualified city officer to perform the duties of Assistant City Manager during disability or absence of the Assistant City Manager.
